WAMMA NextGen Terms and Conditions of Membership

At WAMMA NextGen, we believe in providing flexible, affordable training opportunities for our members. Unlike many martial arts clubs and fitness facilities, we do not require long-term contracts or large upfront financial commitments. Memberships are offered on a flexible recurring payment basis, allowing Members to continue training because they enjoy the program – not because they are locked into a contract.

These Terms and Conditions (“Agreement”) govern membership with WAMMA NextGen (the “Club”). By enrolling in any Club program and paying the applicable membership fees, the Member (or the Member’s parent or legal guardian, where applicable) acknowledges that they have read, understood, and agree to be bound by the following Terms and Conditions.

  1. Membership and Payment Structure
    • The Club offers recurring membership plans that are billed either on a monthly basis or a bi-weekly basis, depending on the membership plan offered at the time of registration.
    • Members who enrolled prior to the introduction of the Club’s bi-weekly billing option (“Legacy Members”) will continue on their existing monthly billing schedule, provided their membership remains active and uninterrupted.
    • A Legacy Member who cancels or pauses their membership acknowledges that, upon reactivation or re-enrollment, they will be required to enroll under the membership plans and billing structure then in effect, including the Club’s bi-weekly recurring payment schedule.
    • Members enrolling under the Club’s current membership plans will be billed on a bi-weekly recurring basis in accordance with the membership selected at registration.
    • All membership fees are processed by pre-authorized payment using the credit card or other approved payment method provided at registration. Payments will be automatically processed in accordance with the Member’s assigned billing schedule (monthly or bi-weekly).
    • Memberships automatically renew on an ongoing basis unless cancelled or placed on hold in accordance with these Terms and Conditions.
    • Memberships are personal, non-transferable, and non-refundable. Once a payment has been processed, no refunds, credits, or prorated adjustments will be issued except in the event of a billing error by the Club.
  1. Adjustment of Class Hours

Members may request to increase or decrease their weekly class hours at any time, subject to the following conditions:

    • Requests to decrease weekly class hours must be submitted in writing at least fourteen (14) days prior to the Member’s next scheduled billing date. The revised membership fee will take effect on the next billing cycle. No refunds, credits, or prorated adjustments will be issued for the current billing period.
    • Requests to increase weekly class hours are subject to Club approval and become effective immediately upon approval. The Member agrees to pay a prorated fee for the additional class hours from the effective date of the change until the next scheduled billing date. Beginning with the next billing cycle, the revised membership fee will be charged in accordance with the Member’s assigned billing schedule.
    • The Club reserves the right to determine the effective date of any adjustment where necessary for administrative purposes or class capacity limitations.
    • All requests to adjust membership hours must be submitted by email to wammanextgen@gmail.com. Requests submitted through social media, text message, or verbal communication will not constitute written notice under this Agreement.
  1. Cancellation of Membership
    • Members may cancel their membership at any time by providing a minimum of fourteen (14) days’ written notice before their next scheduled billing date (monthly or bi-weekly, depending on their plan).
    • Membership fees that have already been processed are non-refundable.
    • Upon cancellation, the Member relinquishes their reserved place within the Club.
    • Members who cancel and later wish to return acknowledge that re-admittance is subject to class capacity and program availability and may require placement on the Club’s waitlist.
    • Cancellation requests must be submitted by email to: wammanextgen@gmail.com.  Requests submitted through social media, text message, or verbal communication will not constitute written notice under this Agreement.
  2. Membership Hold (Pause)
    • Members may request to place their membership on hold by providing a minimum of fourteen (14) days’ written notice before the next billing date.
    • Placement in a class is not guaranteed following a membership hold. Re-admittance is subject to class capacity and program availability.
    • Members wishing to resume training must submit a written request and receive confirmation from the Club before attending any classes.
    • Members returning from a paused membership will be subject to the membership rates in effect at the time of re-admittance.
    • All membership holds and re-admittance requests must be submitted by email to wammanextgen@gmail.com.  Requests submitted through social media, text message, or verbal communication will not constitute written notice under this Agreement.

 

  1. Failed or Declined Payments
    • Members are responsible for ensuring that valid payment information remains on file with the Club.
    • If a scheduled payment is declined for any reason, including but not limited to insufficient funds, expired credit cards, or incorrect payment information, the Club will notify the Member using the contact information on file.
    • The Club reserves the right to suspend the Member’s participation in classes until all outstanding balances have been paid and the account has been brought into good standing.
  2. Class Schedules and Program Changes
    • The Club reserves the right to modify class schedules, instructors, program offerings, class frequency, class capacity, or other operational matters as reasonably required.
    • Reasonable efforts will be made to communicate significant changes by email and through the Club’s website or other official communication channels.
  3. Missed Classes and Class Cancellations
    • Membership fees reserve a Member’s place within the Club and are not based solely on attendance. Accordingly, missed classes do not entitle the Member to refunds, credits, or extensions of membership.
    • Members who are unable to attend their regularly scheduled class are encouraged to attend another age- and skill-appropriate class, where available, subject to instructor approval and class capacity.
    • The availability of alternate classes is intended as a courtesy and is not guaranteed. Attendance at alternate classes remains subject to instructor approval, class capacity, and program suitability.
    • The Club makes every reasonable effort to maintain its published class schedule. Classes are rarely cancelled, and when an instructor is unavailable due to competitions, coaching commitments, illness, or other circumstances, the Club will, where reasonably possible, provide a qualified substitute instructor or offer an alternative class.
    • If a class must be cancelled due to circumstances beyond the Club’s reasonable control, including but not limited to severe weather, facility closures, public health orders, utility interruptions, or other unforeseen events, the Club may, at its discretion, offer a make-up class or alternate training opportunity. Such cancellations do not entitle Members to refunds, credits, or prorated membership fees.
  4. Assumption of Risk and Liability
    • Participation in martial arts, wrestling, Brazilian jiu-jitsu, boxing, kickboxing, strength and conditioning, and related activities involves inherent risks, including the risk of serious injury.
    • Every Member (or the Member’s parent or legal guardian if the Member is under the age of majority) must sign the Club’s Release of Liability, Waiver of Claims and Assumption of Risks Agreement before participating in any Club activity.
    • Subject to applicable law, the Club, its owners, directors, officers, employees, instructors, volunteers, contractors, and representatives shall not be liable for any injury, illness, loss, damage, or expense arising from participation in Club activities or the use of Club facilities.
  5. Privacy
    • The Club respects the privacy of its Members and is committed to protecting personal information.
    • Personal information collected for registration, communication, emergency contact, payment processing, and Club administration will be securely maintained.
    • The Club will not sell or disclose Members’ personal information to third parties except where required by law or where necessary to process payments or administer Club operations.
    • The Club endeavours to comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable privacy legislation.
  6. Notices
    • For the purposes of this Agreement, all required written notices from Members, including requests to adjust membership hours, place a membership on hold, resume a membership, or cancel a membership, must be submitted by email to wammanextgen@gmail.com.
    • Notices submitted through social media, text message, messaging applications, or verbal communication will not constitute written notice under this Agreement.
    • Members are responsible for ensuring that their contact information, including their email address, remains current with the Club.
    • The Club may communicate important information, including billing notices, schedule changes, policy updates, and other operational matters by email and through its official communication platforms. Members are responsible for reviewing these communications in a timely manner.
    • Notices from Members shall be deemed received on the date they are delivered to the above email address.
  7. Amendments
    • The Club reserves the right to amend or update these Terms and Conditions at any time.
    • Members will be notified of any material changes by email and/or through the Club’s website.
    • Continued participation in Club programs or continued payment of membership fees following notice of an amendment constitutes acceptance of the revised Terms and Conditions.
  8. Governing Law
    • This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Manitoba and the applicable laws of Canada.
  9. Entire Agreement
    • These Terms and Conditions, together with the Club’s Release of Liability, Waiver of Claims and Assumption of Risks Agreement and any registration forms completed by the Member, constitute the entire agreement between the Club and the Member with respect to membership.
    • If any provision of this Agreement is determined to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
    • In the event of any conflict between these Terms and Conditions and any promotional materials or verbal representations, these Terms and Conditions shall prevail.

Acceptance

By registering for membership and submitting payment, the Member (or the Member’s parent or legal guardian, where applicable) acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions of Membership.

The Member (or the Member’s parent or legal guardian) further acknowledges that they have received or have been provided access to the WAMMA NextGen Athlete and Family Handbook and agree to comply with the policies, procedures, and expectations contained therein, as amended from time to time. The Member Handbook forms part of the Club’s overall membership policies and should be read in conjunction with these Terms and Conditions.
